These Terms and Conditions set out the basis on which Waste Disposal Belgravia provides waste collection and related services to residential and commercial customers. By booking a collection or otherwise using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any booking.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, business, or organisation requesting or paying for the services.
Services means waste collection, removal, transportation, loading, and any associated activities provided by Waste Disposal Belgravia.
Waste means any items, materials, refuse, rubbish, or goods presented by the Customer for collection and disposal or recycling.
Contract means the agreement between Waste Disposal Belgravia and the Customer comprising these Terms and Conditions and the details confirmed in the booking.
Where the context requires, words in the singular include the plural and vice versa.
Waste Disposal Belgravia provides scheduled and one-off waste collection services, including the removal of general household waste, bulky items, commercial waste, and recyclable materials, subject to applicable regulations and these Terms and Conditions.
The exact scope of the Services for each booking, including the type and estimated volume of Waste, the service location, and any access requirements, will be agreed at the time of booking. Services are provided only in designated service areas notified by us from time to time, which may include Belgravia and surrounding districts.
We reserve the right to refuse to collect any Waste that is not accurately described at the time of booking, is not properly presented or accessible, or which we reasonably believe to be hazardous, prohibited, or unsafe to handle.
3.1 Booking methods
Customers may request a booking by telephone or through any other booking channel we make available. All bookings are subject to acceptance by Waste Disposal Belgravia.
3.2 Information required
When placing a booking, you must provide accurate and complete information, including:
The collection address and contact details.
The type, approximate volume, and nature of Waste to be collected.
Any access restrictions, parking limitations, or time constraints.
Your preferred date and time window for collection.
Waste Disposal Belgravia is entitled to rely on the information you provide. If the information is incomplete or inaccurate, additional charges may apply, or we may refuse or cancel the booking.
3.3 Booking confirmation
A Contract will be formed only when we confirm acceptance of your booking and provide you with booking details, which may be done verbally or in writing. The booking confirmation will state the agreed service date or time window, any applicable charges, and key service conditions.
3.4 Changes to bookings
If you wish to amend a booking, you must contact us as soon as possible. Any changes are subject to availability and may result in revised charges. We reserve the right to treat significant changes as a cancellation and new booking.
4.1 Access and presentation of waste
You must ensure that our team has safe and reasonable access to the collection point at the agreed time. Waste should be presented in a suitable manner, including bagged or contained where appropriate, and separated according to any instructions we provide.
4.2 Parking arrangements
You are responsible for ensuring adequate parking or loading space for our collection vehicle, including obtaining any necessary permits or authorisations. Any parking charges or penalties incurred due to the absence of proper arrangements may be added to your invoice.
4.3 Health and safety
We reserve the right to refuse to handle any Waste or to suspend work where we reasonably consider that conditions are unsafe, unhygienic, or not compliant with health and safety standards. In such cases, you may still be liable for call-out or partial service charges.
5.1 Service charges
Charges for our Services are based on factors including the type and volume of Waste, labour required, access conditions, and distance travelled. We may provide an initial estimate at the time of booking, which is subject to verification on arrival.
If the actual volume or nature of Waste differs from the description given at booking, or if access is more difficult than stated, we may revise the price before commencing work. If you do not accept the revised price, we may cancel the Service and charge a reasonable call-out fee.
5.2 Payment terms
Unless agreed otherwise, payment is due on or before completion of the Service. We may require a deposit or full prepayment at the time of booking, particularly for larger collections or commercial Customers.
We accept payment by the methods we notify from time to time, which may include cash, card, or bank transfer. All sums are payable in pounds sterling unless otherwise agreed.
5.3 Late or non-payment
If payment is not received when due, we may:
Withhold or suspend further Services until full payment is made.
Charge interest on overdue amounts at the statutory rate applicable to business-to-business or consumer contracts, as relevant.
Recover from you all reasonable costs incurred in collecting overdue amounts, including debt recovery and legal fees.
5.4 VAT and other taxes
Where applicable, Value Added Tax or other statutory charges will be added to our prices at the prevailing rate and clearly stated on your invoice.
6.1 Customer cancellations
You may cancel or reschedule your booking by contacting us directly.
For standard bookings, if you cancel or request rescheduling more than 24 hours before the agreed collection time, no cancellation fee will generally be payable, unless we have incurred specific costs on your behalf.
If you cancel or reschedule within 24 hours of the agreed collection time, we may charge a reasonable cancellation fee to cover travel, labour allocation, and lost time.
If our team arrives at the collection address at the agreed time and is unable to complete the Service due to your act or omission, including lack of access or Waste not being available, we may treat the booking as cancelled and charge an attendance or call-out fee.
6.2 Company cancellations and rescheduling
We aim to provide Services on the agreed date and within the agreed time window, but this may be subject to traffic, operational issues, or unforeseen circumstances.
We reserve the right to cancel or reschedule a booking where necessary. In such cases, we will notify you as soon as reasonably practicable and offer an alternative date or time. We will not be liable for any indirect or consequential loss arising from such cancellation or rescheduling, subject to section 9 below.
7.1 Compliance with waste regulations
Waste Disposal Belgravia operates in accordance with applicable UK waste management and environmental regulations. Waste collected by us will be transported and processed through authorised facilities for recycling, recovery, or disposal as appropriate.
By using our Services, you agree not to present any Waste in breach of law or that would cause us to be in breach of our regulatory obligations.
7.2 Prohibited and restricted waste
Certain types of Waste are prohibited or restricted, including but not limited to:
Hazardous materials such as chemicals, solvents, asbestos, and certain oils.
Medical or clinical waste, syringes, and biohazardous materials.
Explosives, pressurised containers, or flammable substances not declared and agreed in advance.
Any item that we reasonably consider unsafe or unsuitable for collection.
We may refuse to remove any such items, even if they were not disclosed at booking. If prohibited Waste is unknowingly collected, you may be liable for any additional handling, treatment, or disposal costs, as well as any regulatory fines or penalties arising.
7.3 Waste ownership and responsibility
You confirm that you own the Waste presented for collection or are authorised by the owner to dispose of it. Responsibility for the Waste transfers to us once it has been loaded onto our vehicle, except where it is later found to be prohibited or presented in breach of these Terms and Conditions.
You agree to:
Provide accurate information about the Waste and access conditions.
Ensure safe and unobstructed access for our team and vehicles.
Comply with any reasonable instructions given by our personnel.
Refrain from abusive, threatening, or unsafe behaviour towards our staff.
If you fail to meet these obligations, we may suspend or cancel the Service and charge reasonable costs arising from your failure to comply.
9.1 Our responsibility
We will provide the Services with reasonable skill and care and in accordance with these Terms and Conditions.
If we fail to provide the Services as agreed, our liability will, to the maximum extent permitted by law, be limited to one of the following, at our option:
Re-performing the relevant Service, or
Refunding the charges paid for the affected Service.
9.2 Exclusions of liability
To the fullest extent permitted by law, we will not be liable for:
Any loss of profit, loss of business, loss of contracts, or loss of opportunity.
Any indirect or consequential loss or damage.
Any damage to driveways, paths, or access routes caused by the weight or movement of our vehicles, where you have directed us to use such routes or where they are reasonably necessary for service delivery.
Any damage arising from the collection of items that are fragile, poorly packed, or not reasonably capable of being moved without risk, unless our team has acted negligently.
9.3 Non-excludable liabilities
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot lawfully be excluded or limited.
You agree to indemnify and keep us indemnified against all claims, losses, liabilities, costs, and expenses arising from:
Your breach of these Terms and Conditions.
Your provision of prohibited or misdescribed Waste.
Any claim by a third party that the Waste did not belong to you or was removed without proper authority.
If you are dissatisfied with our Services, you should contact us as soon as possible, providing your booking details and a clear description of the issue.
We will investigate your complaint and aim to respond within a reasonable time. Where appropriate, we may offer a remedy such as re-performing part of the Service or issuing a partial refund, in line with our obligations and section 9 above.
In the event of a dispute that cannot be resolved directly, the parties may consider using alternative dispute resolution methods before resorting to court proceedings.
We collect and use your personal information for the purpose of managing bookings, providing Services, processing payments, and communicating with you. We will handle your data in accordance with applicable data protection laws and keep it secure and confidential, except where disclosure is required by law or necessary to provide the Services.
By placing a booking, you consent to the use of your information for these purposes. You may contact us to access, correct, or update your personal information where permitted by law.
We may update or amend these Terms and Conditions from time to time. Any changes will not affect Contracts already formed, but will apply to future bookings made after the updated terms are published or otherwise communicated.
It is your responsibility to review the current Terms and Conditions when placing a new booking.
We will not be liable for any failure or delay in performing our obligations where such failure or delay results from events, circumstances, or causes beyond our reasonable control. These may include extreme weather, strikes, transport disruptions, accidents, or regulatory changes.
Where a force majeure event occurs, we will notify you as soon as reasonably practicable and take reasonable steps to minimise any impact on the Services.
We may assign or subcontract our rights and obligations under the Contract, provided this does not materially affect the level of service you receive.
You may not assign or transfer your rights or obligations under the Contract without our prior written consent.
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court or competent authority, that provision will be severed to the minimum extent necessary and the remaining provisions will continue in full force and effect.
The Contract, together with any booking confirmation and these Terms and Conditions, constitutes the entire agreement between you and Waste Disposal Belgravia in relation to the Services. You acknowledge that you have not relied on any statement or representation not expressly set out in the Contract.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms and Conditions or the Services, without prejudice to any statutory rights you may have as a consumer regarding the bringing of claims in your local courts.
